ClariLung Terms of Service

1. Acceptance

By creating an account or using ClariLung you agree to these Terms. If you don't agree, don't use the app.

2. What ClariLung is

ClariLung is a wellness application designed to help you track and manage your journey to quit vaping, smoking, weed, or cigars. ClariLung does not provide medical advice, diagnosis, or treatment. The AI Coach provides general wellness support and is not a substitute for professional medical or psychological care.

3. Eligibility

You must be at least 13 years old to use ClariLung. If you are under 18, you represent that you have parental consent.

4. Your account

You are responsible for maintaining the security of your account. Use a strong password. Don't share your credentials. You are responsible for all activity under your account. If you suspect unauthorised access, notify us immediately at ceo@duskfieldstudios.com.

5. Subscriptions & payments

ClariLung offers a 7-day free trial followed by a paid subscription. Premium subscriptions are billed through the Apple App Store (StoreKit), the Google Play Store (Play Billing), or directly via Stripe on the web. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.

6. Refund & cancellation policy

Cancelling a subscription stops future renewals — it does not delete your account or your data, and it does not trigger an automatic refund for time already paid.

• iOS (App Store): Refunds are handled by Apple at reportaproblem.apple.com. Apple's policies — not ours — determine eligibility.
• Android (Google Play): Refunds are handled by Google via the Play Store or play.google.com/store/account/subscriptions.
• Web (Stripe): Email ceo@duskfieldstudios.com within 14 days of the charge. We process Stripe refunds at our discretion; see the full Refund & Cancellation Policy for details.

7. AI Coach

The AI Coach is powered by Anthropic's Claude. AI output may occasionally be inaccurate or unsuitable for your specific situation. The coach is not a licensed therapist, counsellor, or medical professional. If you are experiencing a medical or mental health emergency, call 911 or the 988 Suicide & Crisis Lifeline.

8. Acceptable use

You agree not to:

• Abuse the AI Coach with harmful or abusive prompts
• Attempt to access other users' data without authorisation
• Reverse engineer, decompile, or attempt to extract source code from the app
• Use ClariLung to promote vaping, tobacco, or cannabis products
• Scrape ClariLung programmatically beyond what your normal interactive use generates
• Use ClariLung to commit fraud, harass other users, or violate any applicable law

We may suspend or terminate accounts that violate this section without notice.

9. Your data and content

You own the journal entries, craving logs, and other content you create. You grant us a limited licence to store, process, and display that content as needed to deliver ClariLung to you. See our Privacy Policy for details on data collection, processors, and your rights.

10. Intellectual property

The ClariLung name, logo, design, code, and all original content provided by us are owned by Duskfield Studios LLC. You may not copy, modify, distribute, or create derivative works of the app or its assets without our written permission.

11. Disclaimer of warranties

ClariLung is provided "as is" without warranty of any kind, express or implied. We do not guarantee that the app will help you quit, that streaks will be accurate, that the AI Coach will always be available or correct, or that the app will be free of bugs or interruptions.

12. Limitation of liability

To the maximum extent permitted by law, Duskfield Studios LLC's total liability to you for any claims arising from your use of ClariLung shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.

13. Governing law & disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law provisions. Any dispute arising from your use of ClariLung shall be resolved in the state or federal courts located in Los Angeles County, California.

14. Changes

We may update these Terms. Material changes will be communicated via in-app notification or email at least 14 days before they take effect. Continued use of ClariLung after changes take effect constitutes acceptance.
